Pursuant to and for the purposes of the legislation cited in the subject, Agenzia Caorle snc di Mattiuzzi Mery e C., wishes to inform you in advance of both the use of your personal data and your rights, informing you of the following: The data controller is Mattiuzzi Mery, legal representative of Agenzia Caorle snc di Mattiuzzi Mery e C., with registered office in Caorle, Viale Santa Margherita 155/c.
To carry out our real estate brokerage activities and fulfill your request for services, we use certain data about you. This includes identification data, contact information (address, landline, mobile, fax, email), property information, financial standing, land registry and property ownership certificates, and data relating to your family composition.
This data will be provided by the interested party and will be collected by our staff and collaborators, including electronically or telematically, in order to carry out real estate brokerage activities, to perform a contractually agreed service or transaction, to verify the progress of contractual relationships and the associated risks.
Please note that providing this data is mandatory, meaning that otherwise we would be unable to fulfill, in whole or in part, the aforementioned mandate, and that your data may also be collected from other parties. Certain information may also be required to be disclosed by you or third parties due to legal obligations (e.g., pursuant to anti-money laundering legislation).
Your identification data will also be processed to fulfill obligations under national laws, regulations, and EU legislation, or by provisions issued by authorities authorized by law and by supervisory or regulatory bodies. This processing does not require your consent. Information relating to your property, including photos, will also be processed for promotional and commercial purposes aimed at properly fulfilling the assigned mandate and may therefore be disseminated through publication on the data controller’s websites, social networks, and/or printed publications, subject to your express consent.
Your email address may be used by the data controller to send you commercial communications about products and services similar to those provided, pursuant to and for the purposes of paragraph 4 of Article 130 of Legislative Decree 196/2003. You may object to this processing at any time.
The opposition will have no effect on the pursuit of the main purpose of carrying out the real estate brokerage activity.
Your data will be disclosed to our internal administrative staff and our external collaborators, a list of which is available at our headquarters. Your data will also be disclosed to our service providers, such as IT service companies, outsourcing companies, consultants and freelancers, insurance companies, debt collection companies, fraud control companies, entities and/or charities, and companies or entities appointed by us as data controllers, a list of which is available at our headquarters.
Furthermore, your data may be communicated to technicians for all inspections on the property you are interested in to be carried out at the Land Registry and/or other institutions, bodies, or registers.
All personal data provided will be processed in compliance with the principles of lawfulness, fairness, relevance, and proportionality, only using the methods, including computerized and electronic means, strictly necessary to achieve the purposes described above.
In any case, personal data will be retained for a period of time no longer than strictly necessary to achieve the indicated purposes. Personal data that does not need to be retained for the indicated purposes will be deleted or anonymized. Please note that the information systems used to manage the collected information are configured, from the outset, to minimize data usage.
Finally, we remind you that, as the data subject, you have the rights set forth in Article 7 of the Privacy Code and Article 15 of the GDPR, specifically the rights to:
I. obtain confirmation of the existence or otherwise of personal data concerning you, even if not yet recorded, and communication of such data in an intelligible form;
II. obtain information on: a) the source of the personal data; b) the purposes and methods of the processing; c) the logic applied in the event of processing carried out with the aid of electronic means; d) the identification details of the data controller, data processors, and the designated representative pursuant to Art. 5, paragraph 2 of the Privacy Code and Art. 3, paragraph 1, GDPR; e) the entities or categories of entities to whom the personal data may be communicated or who may become aware of it in their capacity as designated representative(s) in the territory of the State, data processor(s), or persons in charge of processing;
III. obtain: a) the updating, rectification, or, where applicable, integration of the data; b) the erasure, anonymization, or blocking of data processed unlawfully, including data whose retention is unnecessary for the purposes for which it was collected or subsequently processed; c) certification that the operations referred to in letters a) and b) have been notified, including their content, to those to whom the data was communicated or disseminated, unless this requirement proves impossible or involves a manifestly disproportionate effort compared with the right being protected;
IV. object, in whole or in part: a) on legitimate grounds, to the processing of your personal data, even if pertinent to the purpose of its collection; b) to the processing of your personal data for the purposes of sending advertising or direct sales materials or for conducting market research or commercial communications, through the use of automated calling systems without human intervention, by email, and/or through traditional marketing methods such as telephone and/or postal mail.
Where applicable, you also have the rights set forth in Articles 16-21 of the GDPR (right to rectification, right to be forgotten, right to restriction of processing, right to data portability, right to object), as well as the right to lodge a complaint with the Supervisory Authority.
